Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and SECURIGHT PTY LTD (ACN 606 659 125, ABN 25 606 659 125), an Australian proprietary company limited by shares, with its registered office at 43 Sanctum Drive, Weir Views, VIC 3338, Australia, doing business as "Pet Capsule" ("Pet Capsule", "we", "our", "us"). By using the Pet Capsule App ("the App") or visiting petcapsule.app ("the Website"), you agree to these Terms. If you do not agree, please do not use the services.

2. Description of Service

Pet Capsule is an AI-powered pet care app for dog and cat owners. The v1 launch includes:

Pet care record tracking (records, medications, vaccinations, weight trends)
Care management (tasks, schedules, walks)
Memory storage (photos, milestones, timelines, on-device + iCloud)
AI-assisted general information (photo care notes, breed identification, food reference lookup, care note summaries, AI chat) — all routed through our secure server-side proxy
Document vault (vet records, insurance, certificates) protected by a local PIN
Financial tracking (expenses, insurance, budgets)
Emergency preparedness (storing vet contacts, emergency contacts, and key pet documents)

The App is available on iOS and iPadOS, with Apple Watch and Android versions in development. The Website provides editorial content (blog, breed guides, and a general care library), free pet-care tools, and the waitlist signup.

Earlier roadmap features that would involve public user content or multi-user sharing have been deferred from v1. They are not currently available and will require updated legal/privacy terms before launch.

3. Disclaimers — Read This First

3.1 Pet Capsule is not veterinary advice

Everything on the Website (including the editorial library at /resources/, /health/, and /breeds/) and in the App (including AI photo care notes, care note summaries, breed care notes, food reference lookup, AI chat, emergency contact and document organisation, calculators, and notifications) is general consumer information to help you have a smarter conversation with your veterinarian. It is not veterinary advice, diagnosis, or treatment. SECURIGHT PTY LTD does not make any clinical claim, does not establish any veterinarian-client-patient relationship with you, and does not warrant the accuracy, completeness, or currency of any content. No contributor to Pet Capsule is currently a licensed veterinarian. See our Editorial Policy for the full disclosure of who writes our content and which references we use.

3.2 AI features may be wrong

Pet Capsule uses third-party AI models (currently primarily Google Gemini, and potentially others over time) to generate analyses, suggestions, written content, and chat responses. AI models make mistakes — sometimes confidently. We do our best to test, route, constrain, and disclaim them, but we cannot prevent every error. You agree to treat AI output from Pet Capsule as one input among many, not as a final answer, and to confirm anything that matters with a veterinarian who can examine your pet.

3.3 In an emergency, call your vet — not us

If your pet is experiencing an acute event — collapse, suspected poisoning, severe bleeding, seizure, difficulty breathing, suspected fracture, choking, or any other distress — contact your veterinarian, an emergency animal hospital, or your local animal poisons helpline immediately. Do not rely on this App or Website for emergency medical decisions. Any general contact details we may reference are not a substitute for direct veterinary contact. The dispute-resolution process in Section 18 does not apply to emergencies — call a vet first.

3.4 You agree to use Pet Capsule with these limits in mind

By using Pet Capsule, you confirm that you have read Sections 3.1–3.3 above and that you accept the App and Website on those terms. If you cannot accept those limits, please do not use Pet Capsule. Nothing in this Section 3 excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other consumer-protection laws of your jurisdiction that cannot be excluded by agreement.

4. User Accounts

You may use core local/iCloud features without an account. Apple or Google sign-in is required for account, AI, subscription, referral, and other server-backed features. Apple sign-in is offered first per Apple's platform requirements.
You must provide accurate information when creating an account
You are responsible for maintaining the security of your device, sign-in credentials, and any PINs you set in the App (including the Vault PIN, which we cannot reset for you)
The App is intended for adults. You must be at least 18 years old to use the App, create an account, or join the waitlist. The final storefront age rating is determined by Apple App Store Connect and Google Play Console based on their current questionnaires.
You confirm that you are not a resident of the United States or Canada. The App is not offered to residents of those countries at launch.
You are responsible for all activity that occurs under your account
You must notify us immediately of any unauthorised use of your account at [email protected]

5. Subscriptions & Payments

Pet Capsule offers auto-renewable subscriptions managed through Apple's App Store:

One-time image packs may also be available. Prices are displayed in your local App Store currency and may vary by territory.

5.1 Billing Terms

All subscriptions include a 7-day free trial for new subscribers
Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
Any unused portion of a free trial period will be forfeited when you purchase a subscription
You can manage and cancel subscriptions in your App Store account settings
Refunds are handled by Apple per their refund policy

5.2 Free Tier

Core features including pet profiles, health records, care tasks, memories, and basic AI usage remain accessible on the free tier. Free tier users have daily limits on AI features.

5.3 App Store Licensed Application Terms (Apple)

The App is licensed, not sold, to you for use only under these Terms. Because the App is made available through the Apple App Store, your licence is also governed by Apple's standard Licensed Application End User License Agreement (EULA), except where these Terms are more restrictive, in which case these Terms apply. You acknowledge that:

these Terms are between you and SECURIGHT PTY LTD only, not with Apple, and Apple is not responsible for the App or its content;
Apple has no obligation to provide maintenance or support for the App;
Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or intellectual-property claims;
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If the App becomes available on Google Play or other stores, that store's standard licence and billing terms will apply in the same way.

6. AI Features & Limitations

Pet Capsule uses Google's Gemini AI to power certain features. These features exist only to provide general information and to help you organise records, generate summaries and notes, set reminders, and prepare for conversations with your veterinarian. They are not intended to diagnose, treat, triage, assess urgency, confirm food safety, or make any decision about your pet. By using AI features, you acknowledge and agree that:

AI results are generated by third-party AI models and may be inaccurate, incomplete, or inappropriate
We provide AI features "as-is" without warranty of accuracy, reliability, or fitness for any particular purpose
AI features are for general information and organisation only and must not be relied upon for pet health, diet, medication, safety, or emergency decisions — confirm anything that matters with a qualified veterinarian
You should not upload sensitive personal information (financial data, government IDs) through AI features
AI-generated content (images, text) may be subject to Google's usage terms
We reserve the right to limit, modify, or discontinue AI features at any time
AI usage is subject to rate limits based on your subscription tier

7. User Content

You retain full ownership of all content you create in Pet Capsule, including photos, health records, memories, notes, and documents.

By using export or sharing features that you initiate, you grant Pet Capsule only the limited rights needed to process that action. Content shared through the iOS share sheet is handled by the destination service you choose.
This license ends when you delete the shared content or your account
We do not claim ownership of any user-generated content
You are responsible for ensuring you have the right to share any content you upload

8. Community, Social & Lost-Pet Features

Community feeds, comments, public user posts, lost-pet alerts, and caregiver invitations are not part of the v1 launch. If we add those features later, we will update these Terms and the Privacy Policy before launch and may require a fresh acceptance.

9. No Professional or Veterinary Services

Pet Capsule is a consumer pet-care organisation app. It is not a provider of professional services of any kind. By using the App or Website, you acknowledge and agree that Pet Capsule does not provide, and is not a substitute for:

veterinary advice, diagnosis, treatment, or a veterinarian-client-patient relationship (VCPR);
emergency, urgent-care, or triage services, or any assessment of how urgent a situation is;
poison-control advice or any guarantee that a food, plant, substance, or product is safe for your pet;
veterinary nutritionist, dietitian, behaviourist, or training services;
pet-sitting, boarding, walking, grooming, or other in-person pet-care services;
pharmacy, prescription, or medication-dispensing services;
a marketplace, broker, or intermediary for any goods or services;
payment-processing, banking, insurance, or financial services (subscriptions are billed by the relevant app store, and any expense or insurance features are for your own record-keeping only).

All AI features, editorial content, calculators, reminders, and summaries are provided for general information and personal organisation only, to help you keep records and prepare for conversations with a qualified veterinarian. They are not a clinical assessment and must not be relied upon to make decisions about your pet's health, diet, medication, or safety. In an emergency, contact a veterinarian or a pet poison-control service directly. You remain solely responsible for your pet's care and for obtaining professional advice from appropriately qualified providers.

10. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Upload harmful, offensive, or inappropriate content
Attempt to access other users' data or accounts
Reverse engineer, decompile, or exploit the app or its AI features
Abuse the referral program with fake accounts or fraudulent referrals
Use automated tools, bots, or scrapers to access the service
Interfere with or disrupt the service or its infrastructure
Upload malware, viruses, or malicious code
Circumvent rate limits or usage restrictions

11. Intellectual Property

Pet Capsule, its logo, design, branding, website content, blog articles, breed guides, and interactive tools are owned by Pet Capsule or its licensors. You may not copy, modify, distribute, sell, or create derivative works from our intellectual property without written permission.

The blog articles, breed guides, and resource content on our Website are provided for personal, non-commercial use. You may share links to our content but may not republish or reproduce it without permission.

12. Third-Party Integrations

Pet Capsule integrates with several third-party services. Your use of these integrations is also subject to those services' terms:

Apple Inc. — Sign in with Apple, CloudKit, StoreKit, Apple Maps. Subject to Apple's Terms.
Google LLC — Sign in with Google, Gemini AI (paid tier), Places, Maps, Environment APIs. Subject to Google's Terms.
Supabase Inc. — Server infrastructure (authentication, edge functions, database). Subject to Supabase's Terms.
Cloudflare, Inc. — Website hosting (Pages), CDN (R2 at images.petcapsule.app), DDoS protection. Subject to Cloudflare's Terms.
Brevo SAS (EU) — Transactional emails and CRM for the waitlist. Subject to Brevo's Terms.
Moxie Observe (Securight) — First-party cookie-free analytics and error tracking, operated by our company. Subject to these Terms.

We are not responsible for the availability, accuracy, or performance of third-party services.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

Pet Capsule is provided "as is" and "as available" without warranties of any kind, either express or implied
We disclaim all warranties including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement
We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the app
This includes, without limitation, damages arising where a user relies on AI features, editorial content, or other general information for pet health, diet, medication, safety, or emergency decisions (which they must not do), as well as loss of data or service interruptions
In no event shall our total liability exceed the greater of AUD $100 or the amount you have paid for the service in the 12 months preceding the claim

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

14. Indemnification

You agree to indemnify, defend, and hold harmless Pet Capsule, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App or Website
Your violation of these Terms
Your violation of any third-party rights
Content you create, upload, or share through the service

15. Account Deletion & Termination

You may stop using Pet Capsule at any time by deleting the App. You may also delete your account and all associated server-side data from the App's settings or by emailing [email protected] with "Delete account" in the subject line.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion. Upon termination, your right to use the service ceases immediately, but these Terms continue to apply to any prior use.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions, power failures, internet or telecommunications failures, or third-party service outages.

17. Data Protection & Editorial Policy

Your use of Pet Capsule is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. Our Editorial Policy describes how we write, source, AI-assist, and review the editorial library on the Website. By using Pet Capsule you acknowledge that you have read and understood both policies.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Victoria, Australia. Any dispute between you and SECURIGHT PTY LTD arising from or relating to these Terms, the App, or the Website ("Dispute") shall be resolved as follows:

Good-faith negotiation: The parties shall first attempt to resolve any Dispute through informal negotiation. To start this stage, email [email protected] with "Dispute" in the subject line and a description of the issue. The 30-day negotiation window starts when we acknowledge receipt.
Mediation: If negotiation fails after 30 days, the parties agree to attempt resolution through mediation administered by the Resolution Institute (Australia), held in Melbourne, Victoria or remotely.
Courts: If mediation fails or either party withdraws, the courts of Victoria, Australia have non-exclusive jurisdiction over the Dispute.

Carve-outs: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information, and you may bring small-claims matters in the small claims tribunal of your country of residence.

For users in the European Economic Area or United Kingdom: Nothing in these Terms affects your statutory rights under applicable consumer protection laws, including your right to bring claims in your country of residence under EU Regulation 1215/2012 (Brussels I) or equivalent UK law.

For Australian consumers: These Terms do not exclude, restrict, or modify any consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

Territorial availability: At launch, the App is available in App Store and Google Play territories except the United States and Canada. You must not create an account, purchase a subscription, or use the App if you are a resident of the United States or Canada. We may expand or change territories at any time. If the App is not available in your territory, these Terms apply to your use of the Website only.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pet Capsule regarding your use of the service. They supersede any prior agreements or understandings.

21. Changes to Terms

We may update these Terms from time to time. For significant changes, we will provide notice via email (for account holders) or a prominent notice on the Website at least 30 days before the changes take effect. Continued use of Pet Capsule after the effective date constitutes acceptance of the updated Terms.
